TERMS OF SALE
LIABILITY: All items are sold “as is” and “where is” without warranty either expressed or implied. All sales will be final. The City may withdraw an item at any time from the auction sale.
The City of Troy assumes no liability for inaccurate or erroneous descriptions contained in any descriptive material pertaining to the auctioned equipment. Technical issues beyond the control of the City of Troy may result in a non-award with the item being relisted for auction.
PICK-UP: The equipment can be picked up at the Troy City Hall, Purchasing Department 500 West Big Beaver, Troy, MI 48084 between the hours of 8 AM to 4 PM, as the Building closes at 4:30 PM. Prior to picking up equipment from the Purchasing department, present your invoice and make payment in the Treasurer’s Office. Once payment is made, the receipt and proper identification must be presented to the assigned City of Troy Purchasing Department personnel to obtain equipment.
All equipment is to be removed at the risk and expense of the purchaser. Items must be picked up in person from the City storage area. Mailing / delivery service cannot be provided. The equipment must be removed without City staff participation.
TIME LIMIT: If equipment and/or items are not picked up within 5 working days after the auction expiration date and time, the City of Troy reserves the right to retain the equipment and re-list the equipment for auction.
PAYMENT: All equipment and/or items purchased must be paid in full.
The Treasurer’s Office is located at 500 West Big Beaver Rd., Troy, MI 48084 (upper level). Sales tax will be charged on the sale. The City Treasurer accepts cash, certified or cashier’s check, or money orders with a valid picture I.D. An ATM is available in the Police Department reception area.
NO PERSONAL CHECKS, OUT-OF-STATE OR CANADIAN CHECKS WILL BE ACCEPTED.
GOVERNMENTAL ENTITY / SCHOOL: If a governmental entity or school is the successful bidder, a tax exemption form will be required before the equipment can be removed from the premises.
If the successful bidder is another governmental entity including schools, that entity’s check will be adequate form of payment.
If the successful bidder is not a governmental entity – a 6% sale tax will be added to the final bid price.
Due to recent fraudulent registration information submitted by bidders, the City of Troy now requires to see a valid driver’s license from the successful bidder(s). The Purchasing department is precluded from consummating a sale without a valid driver’s license. The driver’s license information must match the bidder’s information on the invoice. If it does not match, the City has the right to decline the sale and bar that bidder from future sales.
In the event a buyer fails to consummate a sale, after his/her bid has been accepted by the City of Troy, he/she will be barred from future e-Auctions conducted by the City for a period of three years. Reconsideration or appeal can be made with the entity’s Purchasing agent or his/her designee within two weeks of the notice to be barred. Their decision as to reinstatement will be considered in the entity’s best interest and will be final.
In cases of repeated defaults i.e. more than one-time, the buyer may also be barred from ANY further participation in surplus auctions on this entire website and be prohibited from re-registering under a new email address.
